These Terms of Service (hereinafter "ToS") govern the use of the RefCampaign platform accessible at https://refcampaign.com (hereinafter "the Platform").
The Platform is published by PAYET FABRICE, sole proprietor registered in the national register of companies under SIREN number 798 679 296.
Use of the Platform implies full acceptance of these ToS.
User: refers to any individual or legal entity using the Platform.
Merchant: refers to the User who creates and manages affiliate programs via the Platform.
Affiliate: refers to the User who registers for an affiliate program to promote a Merchant's products or services.
Affiliate Program: refers to a program created by a Merchant allowing Affiliates to promote its products or services in exchange for commissions.
Commission: refers to the compensation paid by the Merchant to the Affiliate for each sale or action completed via their affiliate link.
Access to the Platform is free to view general information. Certain features require account creation and may be subject to a paid subscription.
Users must have internet access and an up-to-date web browser to use the Platform. Internet access and telecommunications network usage costs are the User's responsibility.
PAYET FABRICE reserves the right to modify, suspend or interrupt all or part of Platform access at any time, without notice.
To use certain Platform features, Users must create an account by providing accurate and current information.
Users agree to:
• Provide accurate, complete and current information
• Maintain confidentiality of their login credentials
• Immediately notify PAYET FABRICE of any unauthorized use of their account
• Create only one account per person or entity
Registration on the Platform is strictly reserved for adults (18 years and older) or legal entities represented by an adult. RefCampaign does not knowingly collect data from minors; should this occur, a parent or guardian may contact us at contact@refcampaign.com so that the data is deleted.
Users are solely responsible for use of their account and actions performed through it.
RefCampaign is a platform allowing Merchants to create and manage affiliate programs, and Affiliates to promote products or services in exchange for commissions.
The Platform offers:
• Creation and management of affiliate campaigns
• Real-time tracking of clicks, conversions and commissions
• Integration with Stripe for automatic conversion tracking
• Management of payments to Affiliates
• Analysis and reporting tools
Tracking data retention: tracking data (clicks, conversions, attributions) is retained according to the subscription plan held by the Merchant: 30 days on the Starter plan, 90 days on the Growth plan, unlimited on the Pro plan. Beyond the applicable window, data is automatically anonymized or deleted.
PAYET FABRICE reserves the right to evolve Platform features at any time.
Merchant Obligations:
• Respect commission terms defined in their programs
• Pay commissions owed to Affiliates within agreed timeframes
• Provide accurate information about their products or services
• Comply with applicable sales and advertising regulations
• Not create fraudulent or deceptive programs
Affiliate Obligations:
• Promote products or services honestly and transparently
• Respect rules defined by the Merchant for their program
• Not use fraudulent or deceptive promotion methods
• Declare their affiliate status in accordance with applicable regulations
• Not generate fraudulent clicks or conversions
General Obligations:
All Users agree to:
• Not disrupt Platform operation
• Not attempt unauthorized access to Platform systems
• Respect intellectual property rights
• Not use the Platform for illegal purposes or contrary to public morals
RefCampaign actively enforces an anti-fraud policy to protect Merchants, legitimate Affiliates, and the integrity of the Platform. The following practices are strictly prohibited:
Tracking fraud:
• Self-affiliation: a Merchant cannot register as an Affiliate in their own program. This prohibition extends to secondary accounts, persons related to the Merchant through close family ties (spouse, civil partner, direct ascendants or descendants, siblings, or any person residing at the same address), employees or contractors of the Merchant, and any legally affiliated entity (subsidiary, sister company, holding).
• Cookie stuffing: injection of an attribution identifier without a genuine click by the user, in particular via invisible iframes, automatic redirects, or third-party scripts loaded without the visitor's knowledge.
• Click fraud: artificial click generation through bots, click farms, or any automation tool (Selenium, Puppeteer, or equivalent).
• Conversion fraud: fake transactions, use of stolen credit cards, or transactions designed to be systematically refunded after the commission has been validated.
• Unauthorized brand bidding: bidding on the Merchant's brand or its variants on paid advertising platforms (Google Ads, Bing Ads, Meta Ads, etc.) without prior written authorization from the Merchant.
Commercial fraud:
• Promo code abuse: public distribution of promo codes reserved for a private audience (for example via browser extensions of the Honey type, comparison sites, or public forums) when such distribution circumvents the Merchant's commercial strategy.
• Channel hijacking: operating fake cashback sites that are not declared to the Merchant, deceptive redirects from a domain unrelated to the promotional content, or any scheme aimed at capturing an attribution without adding value for the Merchant.
• Spam: sending unsolicited emails, SMS, or direct messages (DMs) containing affiliate links. This practice violates the GDPR and exposes the Merchant to legal risk.
• Adware and typosquatting: registering domains close to the Merchant's brand, popunders, pre-installed browser extensions without explicit consent, or any mechanism that imposes an affiliation on the user without informed choice.
Platform protection:
• Reverse engineering of the SDK or undocumented endpoints beyond the use intended by the official documentation (https://docs.refcampaign.com).
• Mass extraction (scraping) of affiliate or merchant data available through the Platform.
• Creation of multiple accounts intended to circumvent subscription plan limits, reuse a free trial period, or fragment a single activity across several identities.
• Resale, sublicensing, or making the Platform accessible to a third party not authorized by RefCampaign.
Sanctions and procedure:
• Graduated procedure: any confirmed breach results, depending on its severity, in a warning, then a freeze of the affected commissions, then suspension of the account, and finally permanent termination with exclusion from the Platform.
• Cancellation of fraudulent conversions: RefCampaign reserves the right to cancel any conversion identified as fraudulent and, consequently, the associated commission. A cancelled commission is owed neither by the Merchant nor by RefCampaign to the Affiliate concerned.
• Cooperation of the suspected Affiliate: upon a substantiated request from RefCampaign or the Merchant, the Affiliate has seven (7) calendar days to provide evidence of the legitimacy of their traffic (logs, sources, screenshots, statements). An extension may be granted upon a substantiated request justifying the inability to respond within this period (holidays, sick leave, technical unavailability). Failing a response or an extension request within the allotted time, the account is automatically suspended until clarification.
• Reminder: at no point does RefCampaign hold the funds exchanged between Merchant and Affiliate. No payment retention by RefCampaign can be invoked against a disputed commission — the financial dispute remains between the Merchant and the Affiliate.
Use of the Platform may be subject to a paid subscription depending on the chosen plan. Prices are indicated on the Pricing page and may be modified at any time.
Payments are made via Stripe. Merchants authorize PAYET FABRICE to debit the subscription amount according to the chosen frequency (monthly or annual).
In case of payment default, access to paid Platform features may be suspended.
Commissions to Affiliates are managed directly between Merchant and Affiliate. PAYET FABRICE is not party to transactions between Merchants and Affiliates.
Users may terminate their account at any time from their account settings or by contacting support at contact@refcampaign.com.
PAYET FABRICE reserves the right to suspend or terminate a User's account in case of:
• Violation of these ToS
• Fraudulent or suspicious activity
• Non-payment of amounts due
• Damage to the Platform's image or operation
In case of termination, User data will be retained in accordance with our Privacy Policy.
PAYET FABRICE strives to ensure Platform availability and reliability. The Platform is accessible 24/7, except for scheduled maintenance, technical incidents, or force majeure. PAYET FABRICE is bound by an obligation of means and does not guarantee uninterrupted or error-free operation. No compensation is owed for temporary service interruptions.
PAYET FABRICE cannot be held responsible for:
• Direct or indirect damages resulting from use or inability to use the Platform
• Disputes between Merchants and Affiliates
• Loss of data, revenue or profits
• Fraudulent use of the Platform by third parties
In any case, PAYET FABRICE's liability is limited to the amount actually received from the User over the past 12 months.
PAYET FABRICE is committed to respecting current regulations on personal data protection, particularly GDPR.
Data collected is necessary for service provision and is not transmitted to third parties without User consent, except legal obligations.

Service Nature
RefCampaign is a software platform (SaaS) enabling merchants to manage their affiliate programs, track affiliate performance, and automate commission calculations.
RefCampaign acts exclusively as a technical tracking and analytics provider.
The platform does not intervene in financial transactions between merchants and affiliates.
Absence of Payment Management
RefCampaign does not receive, hold, redistribute, or guarantee any commission, bonus, or remuneration payments between parties.
Payments due to affiliates are made directly by merchants, outside the platform, according to terms agreed between them.
Consequently, RefCampaign cannot be held responsible for:
• Payment defaults or delays,
• Amount errors,
• or commercial disputes between a merchant and an affiliate.
Tax and Social Responsibilities
Each merchant and affiliate is solely responsible for compliance with their legal, tax, and social obligations, including:
• Declaration and payment of commissions received or paid,
• Compliance with applicable regulations (e.g., micro-entrepreneur status, VAT, DAC7, etc.),
• and communication of their identification information (SIRET, Tax ID, etc.) as needed.
RefCampaign provides no tax or social advice and cannot be considered a paying third party under current regulations.
Users' Legal Status
Merchants and affiliates act independently and are not bound to RefCampaign by any subordination, mandate, or employment contract.
RefCampaign does not participate in any way in determining or validating users' legal, professional, or tax status.
Liability Limitation
Consequently, RefCampaign cannot be held responsible for any direct or indirect consequences related to:
• Contractual breach between a merchant and an affiliate,
• False tax or social declarations,
• or non-compliant use of the platform for payment or fund transfer purposes.
Procedure in case of dispute between a Merchant and an Affiliate
In case of a dispute between a Merchant and an Affiliate regarding a commission, conversion attribution, or execution of an affiliate program, the parties shall first attempt direct amicable resolution. RefCampaign may, at its sole discretion and upon reasoned request from a party, provide technical tracking elements (attribution logs, click logs, conversion timestamps) to inform the discussion. RefCampaign acts neither as mediator, arbitrator, nor judge, and does not rule on the dispute. Failing amicable resolution, the parties shall handle any litigation as their own personal matter, to which RefCampaign is not a party.
Scope
These terms apply to any technical interaction with the Platform: the official @refcampaign/sdk SDK published on npm, the /api/v1/* endpoints documented at https://docs.refcampaign.com, affiliate API keys, and public tracking endpoints.
SDK License
RefCampaign distributes the @refcampaign/sdk SDK under the MIT license. This clause does not restrict the rights granted by said license, but governs the use of the SDK when associated with an active RefCampaign account. Users agree to integrate the SDK in accordance with the official documentation and not to use it to circumvent the contractual obligations set out in these ToS.
API Keys
Affiliate API keys are strictly personal and confidential. Users agree to:
• not disclose them publicly (public git repository, unencrypted client-side code, screenshots)
• rotate them immediately upon suspicion of leakage
• notify RefCampaign within 48 hours of any confirmed compromise
RefCampaign reserves the right to revoke an API key at any time, without notice, in case of abusive use or security risk, without prejudice to the suspension of the associated account.
Rate Limits
Rate limits applicable to public endpoints and the SDK are documented in the technical documentation (https://docs.refcampaign.com). RefCampaign reserves the right to adjust these limits at any time without notice to preserve service stability. Any repeated breach may result in automatic throttling or temporary suspension of the API key.
Technical Restrictions
Unless prior written agreement, Users may not:
• reverse engineer the SDK or undocumented endpoints
• modify the distributed minified SDK code
• integrate the SDK or endpoints into a commercialized competing product
• mass-extract data via scraping or automation
Compatibility
RefCampaign follows a semantic versioning policy for the SDK, documented in the package's CHANGELOG.md. RefCampaign does not guarantee indefinite maintenance of historical SDK versions and recommends following the published LTS versions. A transition period of at least 90 days is observed before any major breaking change.
PAYET FABRICE reserves the right to modify these ToS at any time. Modifications will take effect upon publication on the Platform.
Users will be notified of significant modifications by email or Platform notification. Continued use of the Platform after modification constitutes acceptance of the new ToS.
These ToS are governed by French law.
Any dispute relating to interpretation or execution of these ToS will be submitted, in the absence of amicable agreement, to competent French courts.
